The railways took away their farmland and didn't pay compensation. After waiting 25 years for the money , around 100 farmers had a five-coach passenger train seized. All with the judiciary's help.
The seizure of HariharapurBengaluru passenger train happened in Chitradurga on February 3 after a local court ordered the confiscation for the railway department's failure to compen sate the farmers, whose land was taken in 1991 for tracklaying work. As the locomotive engine and five coaches were handed over to the railway police force (RPF), passengers were accommodated in other trains heading for Bengaluru.
Realizing
...
their mistake and fearing the consequences, railway officials, including divisional engineers, rushed to the station and promised the farmers to compensate them within 45 days. The train was finally allowed to leave for Bengaluru on February 7.
Khalid Ahmed, the farmers' advocate, said he has been fighting the case since 1996. “In 1991, the railways acquired agricultural lands between Chitradurga and Rayadurga, a distance of 100km. Then assistant commissioner-Chitradurga monitored the acquisition and promised land owners to pay compensation with the current market price,“ he said. 300 farmers suffered: More than 300 farmers lost their land and only around 200 of them received proper compensation. The other 100-odd farmers approached Challakere court, de manding better compensation. The case was transferred to Chitradurga court in 2000.
“Then the court directed the railways to compensate the farmers with market price plus interest. But the railways did not follow the direction,“ said C Timmanna, another advocate appearing for the farmers.
The railways have to pay Rs 1crore to 50 farmers within 45 days from February 3. BN Lakshminarayana, advocate appearing for the railways, refused to comment on the issue. “I have been instructed to not to talk to media,“ he told TOI. Where was land acquired: The railways acquired land in Chitradurga-Molakalmur-Challak ere-Rayadurga. Over 300 farmers gave their tiny plots of agricultural and non-agricultural lands to the railways. Some of them continued farming on whatever land was left with them, while some purchased plots in nearby areas. A few of them ventured into business by setting up shops and hotels in and around Chitradurga.
FARMERS HOPE TO BE PAID NOW
P Veeranna, 85, resident of Challakere village, 40km from Chitradurga, hopes he will get a good compensation finally. His elder brother Veeranna gave away their nearly three-acre land, where the Challakere railway station has come up. “I am 85 and my elder brother is 88 now. We have been fighting for justice since 1991 and hope to get the compensation before we die. We are hopeful of getting around Rs 3.5 lakh,“ he said.
After much dilly-dallying, the railways said in 1996 that it would pay a compensation of Rs 39,000 to him. “It was fertile land with huge well-fitted motor pumps. The amount did not match the investment we had made,“ he said.
TIMES VIEW
T he seizure of the train brings to light two shocking things: First, it shows how the voiceless have to fight for decades to get what's due to them and only the judiciary offers them hope. Secondly, it exposes how government agencies put off fulfilling their responsibility till they are forced to. One hopes this case serves as a lesson for agencies and they are prompt in paying compensation. The government must ensure the poor do not end up wasting their whole life fighting legal battles. They deserve a better deal in such matters.
