People keep loitering around tracks everyday. People keep crossing the tracks at LCs until the very last minute even when they see the train coming. And in urban areas it is very common to have people walking along tracks and moving out when the train comes very close.
When thousands of people do such daredevil acts everyday, why will the motorman expect anything else? He sounded the horn and expected people to move away as they usually do. Trains have the right of way on railway tracks. You can't expect them to slow down to a crawl every time they see people on the tracks.

with emergency brakes, the train won't come to a halt immediately. The motorman would have applied the brakes only in the last minute when he realized that people were not moving despite the horn. That would not be sufficient to bring the train to a halt.
No need to divert the blame onto an innocent man to coverup for lack of basic awareness in people.
